Last Will and testament of Joseph J. Barnes.
Essex, Stoddard County, Missouri
Oct. 25th 1884

In the name of God Amen.
I Joseph J. Barnes of the Township of Richland County of Stoddard State of Missouri being of sound mind and memory and considering the uncertainty of this frail and transitory life do therefore make ordain publish and declair this to be may last will and testament that is to say I give and bequeath unto my wife Lucinda Barnes all of my personal and Real estate situated in the County of Stoddard State of Missouri Except Lot 17 and 18 in the town of Essex Block No. 1 and all my money and also all the debts due me at my deceased if any for her use and benefits during her life if she should marry again her husband shall have no controle whatever of it at all whatever and after her deceased all property personal or real and debts if any to be equally divided between three parties now children in Stoddard county State of Missouri namely William Shepard Pruit and Deley Ann Pruitt children of John s. Pruitt and Sarah Ann Pruitt both of the county of Stoddard and State of Missouri and to James Marshal McClain now living with me if the said James Marshal McClain should happen to die before he becomes of age or without a lawful begotten heir of his body the portion coming to him shall be equally divided between the children of John S. Pruit and Sarah A. Pruit and if my wife Lousinda Barnes should die before he becomes of lawful age of twenty one years it is my desire that John S. Pruit should be his guardian. I also give unto William Hux the two lots before described in the town of Essex namely No. 17 and 18 in Block No. One. I also appoint my wife Executrix of my Estate without giving any security whatever. I witness wherefore I have hereunto subscribed my name and affix my seal this 25th day of October A.D. 1884.

Proof of Will

In the Probate Court
Be it Remembered that on this the 12th day of March A.D. 1889 before me P.G. Wilson Judge of the probate Court held in and for the county and State aforesaid, personally appeared John S Pruitt and Abraham Smith who are the subscribing witness to the annexed will of J. J. Barnes deceased and being by me first duly sworn depose and say That the said J.J. Barnes the Testator subscribed the same in their presences and published and declared said will or Instrument of writing to be his last will and testament and that at the time of signing the same he the said testator was of sound and disposing mind and more than twenty-one years of age, and that said deponents attested said will as witnesses thereto by subscribing their names to the same in the presence of the Testator and of each other and at the request of the said testator.

In the Probate Court
I P.G. Wilson Judge of the Probate court of Stoddard County State of Missouri having Examined the foregoing Instrument purporting to be the Last Will of J.J. Barnes deceased and having heard the testimony of John S. Pruitt and Abraham Smith subscribing witnesses thereto in Relation to the Execution of the same do declare and adjudge said Instrument to be the Last Will and testament of the said J.J. Barnes deceased late of Stoddard County, Missouri.
In testimony whereof I have hereunto set my hand and affixed the seal of said court at office in Bloomfield this 12th day of March A.D. 1889
