Last Will and Testament of J.S.F. Briney
In the name of God Amen:
I J.S.F. Briney of the County of Stoddard in the State of Missouri aged 68 years being of sound mind and memory do make and publish this my last will and Testament as follows:
1st It is my will that all my debts be paid out of personal Estate and if the is insufficient I Expressly authorize my Executor hereinafter named to sell at public or private sale such part of my real Estate as may be sufficient for that purpose. It
2nd is my will and request that my Grandson Henry G. Briney take only the sum of Five dollars to be paid out of my personal Estate.
3rd It is my will and request that all the rest residue and remainder of my Estate real personal and mixed be divided equally between my children E.P. Briney andVina Briney. I appoint my son E.P. Briney the Executor of this my last will and Testament revoking all former wills by me made.
In witness whereof I have hereunto subscribed my name this 29th day of March 1889.

The foregoing instrument was at the date thereof signed and declared by the said J.S.F. Briney to be his last will and Testament in the presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto.

Be it Remembered that on this the 26th day of September A.D. 1889 before me P.G. Wilson Judge of the probate Court held in and for the county and State aforesaid, personally appeared Geo. S. White one of the subscribing witness to the annexed will of J.S.F. Briney deceased and being by me first duly sworn depose and say That the said J.S.F. Briney the Testator subscribed the same in his presences and published and declared said will or Instrument of writing to be his last will and testament and that at the time of

signing the same he the said testator was of sound and disposing mind and more than twenty-one years of age, and that said deponents attested said will as witness thereto by subscribing his name to the same in the presence of the Testator and of John Wilson and John T. White and at the request of the said testator.

Briney deceased and being by me first duly sworn depose and say That the said J.S.F. Briney the Testator subscribed the same in their presences and published and declared said will or Instrument of writing to be his last will and testament and that at the time of signing the same he the said testator was of sound and disposing mind and more than twenty-one years of age, and that said deponents attested said will as witnesses thereto by subscribing his name to the same in the presence of the Testator and of Geo. S. White and at the request of the said testator.

I P.G. Wilson Judge of the Probate court of Stoddard County State of Missouri having Examined the foregoing Instrument purporting to be the Last Will of J.S.F. Briney and having heard the testimony of Geo. S. White and J.T. White and John Wilson subscribing witnesses thereto in Relation to the Execution of the same do declare and adjudge said Instrument to be the Last Will and testament of the said J.S.F. Briney deceased late of Stoddard County, Missouri.
In testimony whereof I have hereunto set my hand and affixed the seal of said court at office in Bloomfield this 28th day of Sept 1889

Letters of Testamentary

To whom these presents shall come Greetings
Know ye that the last will and testament of J.S.F. Briney, deceased late of Stoddard County, Missouri that in due form of law, been exibited proved, and recorded in the office of the clerk of the Probate court of Stoddard County Missouri a copy of which is hereunto annexed and in as much as it appears that E.P. Briney has been appointed Executor in and by the said last will and testament, to execute the same, and to the end there the property of the said testator may be preserved for those who shall appear to have right or interest therein and that the said last will and Testament may be executed according to the request and instruction of the said testator we do hereby authorize the said E.P. Briney as such executor, to collect and secure all and singular the goods and chattel rights and credits which were of the said J.S.F. Briney at the time of his death in whosoever hands or possession the same may be found and to perform and fulfill such duties as may be enjoined upon him by said last will and testament so far as there shall be property and the law charge him and in general to do and perform all other acts which are now or may be hereafter requested of him by law.

and for said Stoddard County have hereunto signed my name and affixed the seal of said court. At office in Bloomfield this 28th day of September A.D. 1889.

Executors Bond
On Bond of Administrator with will annexed
We E.P. Briney as principal and Geo. W. Briney, Aut Gregory and W.H. Bacon as securities, are firmly held and bound unto the state of Missouri, in the sum of of One thousand ($1,000) Dollars for the payment of which we do hereby bind ourselves, our heirs, executors and administrators, firmly by these presents, sealed with our seals and dated at Bloomfield, in the state aforesaid this 28th day of September A.D. 1889. The condition of the above bond is that if the said E.P. Briney Executor of the last will and testament of J.S. Briney Deceased late of Stoddard County, Missouri shall will and faithfully execute the said last will and testament and shall make true and faithful Inventories, returns and settlements of accounts of the estate of the said testator according to law and shall moreover do and perform all these matters and things touching the execution of the said last will and testament as are or shall be prescribed by law, or enjoined on him by the order Sentence or secure of any court having competent Jurisdiction then this obligation to be void and of no effect, otherwise to remain in full force.
