I B.H. Rutland declare this to be may last will and Testament.
First, My eternal interests and hopefully committed to "Our Father who are in
heaven".
Second: I will and bequeath after the payment of my debts, all my property, both
real and personal, to my grandson Jefferson Davis Rutland.
Third: I appoint Coppie (sometimes written Copitola) Rutland, (the mother of my
grandson) my executrix, and the Guardian of my grandson; and desire that neither
as executrix nor as Guardian shall she be required to give bond.
Advance, Stoddard County, Missouri, on the night of the 14th of December A.D.
1897.

In Vacation June 25 1900
Be it Remembered that on this the 25" day of June A.D. 1900 before me
Thos. Connelly, Judge of probate Court, held in and for the county and State
aforesaid, personally appeared S.W. Rhodes, who is one of the subscribing
witnesses to the annexed will of Dr. B.H. Rutland deceased, and being by me first
duly sworn deposes and says That the said Dr. B.H. Rutland the Testator,
subscribed the same, and published and declared said will or Instrument of writing
to be his last will and testament and that at

the time of signing the same he, the said testator was of sound and disposing mind,
and more than twenty-one years of age, and that said deponent attested said will as
witness thereto, by subscribing his name to the same in the presence of the Testator
and of each other and at the request of the said testator.

In Probate Court of Stoddard County,
I Thos. Connelly , Judge of the Probate court of Stoddard County, State of
Missouri, having Examined the foregoing Instrument purporting to be the Last Will
of B.H. Rutland, deceased and having heard the testimony of S.W. Rodes and
J.H. Schonhoff, subscribing witnesses thereto, in Relation of the Execution of the
same, do declare and adjudge said Instrument to be the Last Will and testament of
said B.H. Rutland deceased, late of Stoddard county, Missouri.
In testimony whereof I have hereunto set my hand and affixed the seal of said
court at office in Bloomfield this 27"day of June 1900.

To all to whom these presents shall come - Greeting:
Know ye, that the last will and testament of B.H. Rutland, deceased, late of
Stoddard County, Missouri, hath in due form of law been exhibited, proved and
recorded, in the office of the Judge of the Probate Court of Stoddard County,
Missouri, a copy of which is hereunto annexed; and inasmuch as it appears that
Capitola Rutland of said County and State has been appointed Executrix in and by
said Last Will and Testament to execute the same, and to the end that the property of
the said Testator may be preserved for those who shall appear to have a legal right
or interest therein and that the said Last Will and testament May be executed
according to the request and instruction of the Testator, we do hereby authorize her
the said Capitola Rutland as such Executrix, to collect and secure all and singular,
the good and chattels, rights and credits, which were of the said B.H. Rutland at the
time of his death, in whosoever hands or possession the same may be found, and to

perform and fulfill all such duties as may be enjoined upon her by said Last will and
Testament so far as there shall be property, and the law charges her to do; and in
general to do and perform all other acts which are now are or may be hereafter
required of her by law.
In Testimony whereof I Thos. Connelly, Judge of the Probate Court in and for
said County of Stoddard hereunto signed my name and affixed the seal for the said
court at office in Bloomfield, this 27th day of June, A.D. 1900.
