Stoddard County, State of Missouri
Know all men by these presents that I James Bary of the County and State aforesaid being in my right mind and believing that my decease is near at hand do by these presents make my last will.
First that all my Just debts be paid.
Second I will to my beloved and affectionate wife Elizabeth Bary all my money and personal property except 1st I will to my beloved Son John Bary 1 colt 1 year old and all my Blacksmith and carpenter tools. Second I will to my beloved daughter Mary Jones one dollar. Third I will to my beloved daughter Elizabeth Yance one dollar as my last will and testament.
Given under my hand and Seal this the 26th day of of October AD 1870.

Be it remembered that on this the 30th day of January AD 1871 before me Samuel D. Henson Judge of Probate Court within and for the County of Stoddard in the State of Missouri personally appeared James M. Goforth and Oliver P. Tiner who being by me duly sworn upon their oath say that they were present and saw James Bary Sign the foregoing instrument purporting to be the last will and testament of him the said James Bary and heard him publish and declare the Same to be his last will and Testament and that at the time of signing the same the Said James Bary was of sound and disposing mind and that these deponents subscribed their names thereto as witnesses to the same in the presence of the Said testator and of each other at the request of said James Bary;

I Samuel D. Henson Judge of the Probate court of Stoddard county having examined the foregoing instrument of writing purporting to be the last will and Testament of and signed by James Bary and the Testimony of James M. Goforth and Oliver Tiner the witnesses above named do adjudge and declare the said instrument of writing to be the last will and Testament of James Bary deceased.
In Testimony whereof I have hereunto set my hand, and affixed the seal of said Probate Court of Stoddard county at office in Said County this 30th day of January AD 1871.
