State of Missouri, County of Stoddard
In the Name of God I Randolph Davis of the county of Stoddard and in the State of Missouri being of Sound mind and memory and considering the uncertainty of this frail and transitory life Do hereby make ordain publish and declare this to be my last will and testament that is to say First after all my lawful debts are paid and discharged the residue of my Estate Real and personal to be Equally divided between My children to wit Thompson Davis, Eliza Davis, Mary Davis and John Burges now living in the State of Indiana County of Montgomery to have and hold the same to themselves their heirs and assigns forever to amount all my said Estate unto money if such a cause shall be thought best by my said Executor and I hereby give to my said Trustee or Administrator full power and authority to sell any or all of my real estate at private or public sale and pay the Same to my children to wit above mentioned and I also give my trustee full power to collect all debts coming to me and pay all the money now on hand to my children or their heirs or representations. I also give my trustee full power to sell all my stock, hogs, cattle and all my farming utensils, household furniture an or any thing of mine and the Money to be Equally divided between my children. I also appoint William C. Rayburn my trustee or Administrator and give him full power to sell any or all my affects at any time he may think best also to collect any Money owinging to me In Testimony whereof I have hereunto set my hand and Seal this 13th day of December 1865.

Signed Sealed Published and declared by the Said Randolph Davis on this the 13th
day of December 1865 Eighteen hundred and Sixty five and for his last will and
testament in the presence of us who at the request of the said Randolph Davis And
in his presence and in the presence of Each other have hereunto subscribed our
names and respective places of Residence as witnesses.

We further State that he Randolph Davis did on this day and in our presence
appoint William C. Rayburn as his trustee and authorized him to sell all of his
Lands stock and every thing that belonged to him {word covered}

or do as he thinks best at any time he Rayburn may think best and divide the
money between his children. We further state that Randolph Davis made this
request in our presence and we further state that Randolph Davis was in his right
mind and has bin all the time of his sickness up to the present time.
This December the 13, 1865 witness our hand and Seal.

In Vacation of the county court
Be it remembered that on this 25th day of December 1865 personally appeared
before the undersigned Adrian B. Owen Clerk of the county Court of the county
and State aforesaid Charles W. Williams, Elisha Welden and Josiah Daugherty
the subscribing witnesses to the annexed will of Randolph Davis and being by me
first duly sworn the said Charles W. Williams deposes and says that he signed the
name of Randolph Davis the testator to the annexed will by his direction and at his
request and in his presence and that the said Charles Williams, Elisha Weldon
and Josiah Dougherty depose and say that the said Randolph Davis the testator
produced the Said will or instrument of writing and in their presence declared the
Said instrument of writing to be his act and published the Same as his last will.
That he the said testator was at the time of publishing his said will of sound mind
and more than twenty one years of age and that the said deponents attested the Said
will as witnesses thereto subscribing their names to the Same in the presence of the
Said testator.

In witness whereof I Adrian B. Owen Clerk of the county Court of the County of
Stoddard subscribed my Name and affixed the Seal of Said court at office in the
county aforesaid this 28th day of December 1865.
