Last Will and testament of D.Y. Rose dec.
I David Y. Rose of Stoddard County Missouri aged 45 years, being of sound
disposing mind do make and publish this my last will and testament revoking all
former wills by me made.
1st I will and bequeath that all of my Just debts be paid including my funeral
expenses be paid by my executor here in after named.
2nd I will and bequeath my wife Martha J. Rose my Dwelling house, yards, &
garden where I now live, during here natural life or widowhood for her own use
also what cattle and hogs I now own and also I desire that she receive as rents from
my farm I now own the sum of One hundred dollars per annum to be paid by my
son-in-law William H. Huggins. I also desire that my wife Martha share the
benefit of pastures, etc. with my daughter and son-in-law in equal parts.
3rd I give and bequeath to my daughter Elizabeth and her husband William H.
Huggins all the rest of my property real, personal and mixed, also lastly personal
property being 2 work mules and all farm machinery and implements of every
description.
I hereby appoint Daniel Whitledge Executor of this my last will and
testament revoking all former wills by me made. In witness whereof

I have hereunto subscribed my name this 7th day February 1901.

The foregoing instrument was at the date thereof signed and declared by the said
David Y. Rose to be his last will and testament in the presence of us, who at his
request and in his presence, and the presence of each other have subscribed our
names as witness thereto.

In the Probate Court on Vacation Feb 13, 1901
Be it remembered; that on this the 13th day of February A.D. 1901, before me
Thomas Connelly Judge of the Probate Court, held in and for the county and State
aforesaid, personally appeared A.W. Bess and Albert Coissart, who are the
subscribing witnesses to the annexed will of D.Y. Rose deceased and being by me
first duly sworn depose and say that the said D.Y. Rose the testator, subscribed the
same in their presence and published and declared said Will or instrument in writing
to be his Last Will and testament, and that at the time of Signing the same he the
said testator was of sound and disposing mind, and more than twenty one years of
age and that said deponents attested said Will as witnesses thereto by subscribing
their names to the same

in the presence of the testator and of each other and at the request of the said
Testator.

In vacation Feb 13, 1901
I Thomas Connelly Judge of the Probate court of Stoddard County Missouri Having
examined the foregoing instrument of date February 7th 1901 purporting to be the
last will and testament of David Y. Rose deceased late of Stoddard County,
Missouri and having heard the testimony of A.W. Bess and Albert Coissart
subscribing witnesses thereto In relation to the execution of the same do declare
and adjudge said instrument of date Feb 7, 1901 to be the last will and testament of
said David Y. Rose deceased and the same is duly admitted to probate and ordered
on file and of record.
In testimony whereof I have hereunto set my hand and affixed the seal of said court
at office in Bloomfield this 13th day of February 1901

Executors Bond or bond of Administrator with Will Annexed
We D.E. Whitledge as principal and Jonathan Rose and A.W. Bess as securities
are held and firmly bound unto the State of Missouri in the sum of Five Hundred
dollars, for the payment of which we do hereby bind ourselves our heirs, executors
administrators, firmly by these presents.
Sealed with our seals and dated at Bloomfield in the State afore said this 11th day of Feby A.D. 1901.
The condition of the above bond is, that if the said D.E. Whitledge Executor of the
last will and testament of D.Y. Rose, deceased late of Stoddard County, Missouri
shall well and faithfully execute the last will and testament and shall make true and
faithful inventories, returns settlements of accounts of the estate of said testator
according to law, and shall moreover do and preform all the matters and things
touching said execution of said last will and testament as are or shall be presented
by law or enjoined on him by the order sentence or decree of any court having
competent jurisdiction then the obligation to be void and of no effect otherwise to
remain

To all to whom these presents Shall come Greeting:
Know ye that the last will and Testament of D.Y. Rose, deceased, late of Stoddard
County, Missouri, hath in due form of law, been exhibited, proved and recorded in
the office of the Clerk of the Probate Court of Stoddard County, Missouri, a copy of
which is hereunto annexed and in as much as it appears that D.E. Whitledge has
been appointed Executor in and by said last will and Testament to execute the same
and to the end that the property of the said testator may be preserved for those who
shall appear to have a legal right or interest therein; and that the Said last will and

Testament may be executed according to the request and instruction of the said
Testator. We do hereby authorize him the said D.E. Whitledge as such Executor to
collect and secure, all and singular the goods and chattels, rights and credits, which
were of the said D.Y. Rose, at the time of his death, in whosoever hands or
possession the same may be found; and to perform and fulfill all such duties as may
be enjoined upon him by said Last will and Testament, so far as there shall be
property, and the law charge him and in general to do and perform all other acts
which now are, or maybe hereafter required of him by law.
In Testimony whereof I Thomas Connelly Judge of the Probate Court in and for
said Stoddard County, have hereunto signed my name and affixed the seal of said
court, at office in Bloomfield, this 13th day of February 1901.
