LAST WILL AND TESTAMENT


In the Name of God, Amen. I, John W. Swan of Essex, Stoddard County, Mo. being of sound and disposing mind, but recognizing the uncertainty of life, do make and publish this my last will and testament hereby revoking any former wills by me made.

1- It is my desire that my funeral expenses and all just debts be paid; that my funeral be conducted by and under the direction of my beloved wife - Margaret Ann Swan and that a suitable monument mark my last resting place.

2 - I give and bequeath to John, Ethel and Effie Swan - children of my deceased son - Wm. C. Swan, the sum of one ($1.00) dollar each in lawful money.

3 - I give and bequeath all the rest and residue of my property, real, personal and mixed of whatsoever nature, to my beloved wife - Margaret Ann Swan during her natural life time which is to be used as necessary for her support and maintenance and at her death all of the remainder of said property is to go to and be vested in my beloved daughter Addie G. McMullin and her bodily heirs in equal shares.

4 - I hereby nominate and appoint my beloved wife - Margaret Ann Swan and Sylvester McMullen my son-in-law executors of this my Last Will and Testament to act without bond.

In witness whereof I have hereunto subscribed my name this 31st day of October, 1910.

The foregoing instrument was at the date thereof signed and declared by the said John W. Swan to be his last will and testament, in the presence of us, who, at his request and in his presence, and in the presence of each other, have subscribed our names as witnesses thereto.

On this 14th day of June, 1919, before the undersigned M. Walker Cooper, Judge of the probate court personally appeared Margaret Ann Swan, who being duly sworn says that to the bet information and belief of affiant John W. Swan died testate at Essex, Missouri on the 6th day of June, 1919 leaving as his heirs at law Margaret Ann Swan, widow; Addie G. McMullin daughter; John Swan, grandson; Ethel Swan Girley, grand-daughter; and Effie Swan Green, grand daughter the three grandchildren being the heirs of William C. Swan, a deceased son.

BE IT REMEMBERED, That on this -14th -day of- June -, in the year of our Lord One Thousand Nine Hundred and- Nineteen, before me - M. Walker Cooper, Judge - of the-Probate -Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared - J.S. Magee and W.L. Tucker - who being duly sworn upon - their -oath, depose- - and say- -that - they -w -ere - present and saw - John W. Swan - sign the foregoing instrument, of date -October 31st - 19 - 10 - purporting to be - - the Last Will and Testament of h - im - the said - John W. Swan - and heard - him -publish and declare the same to be h - is - Last Will and Testament, and that at the time of signing the same, the said - John W. Swan -was of sound and disposing mind, and that th - ese- deponent -s - and - - other attesting witness - - subscribed their names thereto as witnesses to the same in the presence of the testat - or - and of each other, and at the request of the said testat -or - who was more than 21 years of age at the date of so declaring and signing said instrument.

Swan - deceased, and signed by said - John W. Swan- deceased, late of-Stoddard -County,- Missouri -and having heard the testimony of -J.S. Magee - and - W.L Tucker - subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said - John W. Swan - deceased, and the same is therefore -admitted to probate.

LETTERS TESTAMENTARY
STATE OF MISSOURI

To all to Whom these Presents shall come--GREETING:
Know Ye, That the last will and testament of - John W. Swan - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the -Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that - Margaret Ann Swan and Sylvester McMullin - ha -ve - been appointed execut -ors - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize - them - the said - Margaret Ann Swan and sylvester McMullin - as such Execut- ors -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said - John W. Swan - at the time of h - is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon -them - by said Last Will and Testament, so far as there shall be property and the law charge - them - ; and in general to do and perform all other acts which are now or may be hereafter required of - them - by law.
