LAST WILL AND TESTAMENT


Last Will and Testament of William Jenkins Jr.

In the name of God Amen. I, William Jenkins Jr., being of sound mind and disposing memory and being desirous of making such disposition f my property as to me shall seem proper, do thereby make, publish and declare this to be my last will and testament, hereby revoking all former wills by me made, as follows:

1st. After payment of all just debts, I will , give, devise and bequeath, unto my Father, William Jenkins Sr., One Thousand Nine hundred dollars and all interest due thereon, now in Advance Exchange Bank, Advance, Mo. Also about Sixty Four Dollars, one diamond ring, one ruby ring, and one gold watch all now in possession First St., Dawkins of the 43rd Co., of the 164 Depot Brigade. Also any and all other property of every kind and character of which I may be possessed, all to be the absolute property of my said Father.

2nd. Reposing special confidence in my said Father William Jenkins Sr., I hereby nominate and appoint him executor of this my last will and testament and request and direct that he be permitted to serve without bond.

In witness whereof I have hereunto set my hand at Section "B" of Base Hospital fort Riley Kansas in the presence of Captain C.A. Henry Jr. M.C. and Nurse Frances Harrison whom I have asked to sign as attesting witnesses this 29th day of October 1918.

We Captain C.A. Henry Jr. and Frances Harrison, at the request of William Jenkins, Jr., witnesses his signature to the above and foregoing will which he signed in our presence and declared the same to be his will, and we have signed the same in his presence and in the presence of each other as attesting witnesses thereto.

Commission to Prove Will

The State of Missouri, To any court having a seal, or the Judge thereof, or Justice of the Peace, or any Notary Public, Mayor, or Chief Magistrate of any City or Town having a seal, in the County of Seneca, in the State of Ohio Greeting:
Know ye, that we hereby empower you to cause to come before you at the time and place to be by you appointed, Captain C.A. Henry Jr. M.C. attesting witness to the annexed instrument of writing purporting to be the last will and testament of William M.K. Jenkins, Jr. at the time of the execution and publication of the same as his last will and testament. The examination thus taken, you will reduce to writing and cause the same to be subscribed and sworn to by the said Captain C.A. Henry Jr. M.C. and there upon you shall certify the same under your hand to M.Walker Cooper, Judge of our Probate Court of said County.

In Witness whereof, I, M. Walker Cooper, Judge of said Probate Court, have hereunto set my name and affixed the seal of said court at Bloomfield, Missouri, on this 3rd day of July 1919.

PROOF OF WILL

County of- Seneca To M. Walker Cooper Judge of the Probate Court of Stoddard County, State of Missouri.

BE IT REMEMBERED, That on this -14th -day of- July -, in the year of our Lord One Thousand Nine Hundred and- nineteen, before me - a Notary Public, within and for the county of Seneca, in the State of Ohio, personally appeared - C.A. Henry, Jr., Capt. M.C. - who being duly sworn upon -his -oath, depose-s - and say- s -that - he -w - as - present and saw -William M.K. Jenkins, Jr. - sign the foregoing instrument, of date -October 29th - 19 -18 - purporting to be - - the Last Will and Testament of h - im - the said -William M.K. Jenkins, Jr. - and heard - him -publish and declare the same to be h - is - Last Will and Testament, and that at the time of signing the same, the said - William M.K. Jenkins, Jr.-was of sound and disposing mind, and that th - is - deponent - - and -Frances Harrison, A.N.C. - other attesting witness - - subscribed their names thereto as witnesses to the same in the presence of the testat -or - and of each other, and at the request of the said testat -or - who was more than 21 years of age at the date of so declaring and signing said instrument.

Affiant further states he resides without the state of Missouri in the county of Seneca, State of Ohio, and that the name Frances Harrison, A.N.C. signed to the attesting clause of said will as a witness to said will is the handwriting of said Frances Harrison, A.N.C. and that the said Frances Harrison, A.N.C. was on October 29, 1918, residing in the state of Kansas and her present residence is unknown to me.

Sworn to and subscribed before me, -a Notary Public for Seneca County, Ohio and I do hereby certify the same to M. Walker Cooper, Judge of the Probate Court of Stoddard County, Missouri, as being the testimony of said subscribing witness in said matter, the day & year first afore said. My term expires June 5, 1922, Charles A. Guernsey, Notary Public.

I, -M. Walker Cooper, Judge - of the-Probate-Court- of Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of - William M.K. Jenkins, Jr. - deceased, and signed by said - William M.K. Jenkins, Jr. - deceased, late of-Stoddard -County,- Missouri -and having heard the testimony of - C.A. Henry, Jr. Capt. M.C. - and - - subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said -William M.K. Jenkins, Jr. - deceased, and the same is therefore - admitted to probate.

LETTERS TESTAMENTARY

To all to Whom these Presents shall come--GREETING:
Know Ye, That the last will and testament of -William M.K. Jenkins, Jr. - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the -Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that -William Jenkins, Sr. - ha -s - been appointed execut - or- in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize -him - the said - William Jenkins, Sr. - as such Execut-or -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said - William M.K. Jenkins, Jr. - at the time of h -is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon -him - by said Last Will and Testament, so far as there shall be property and the law charge - him - ; and in general to do and perform all other acts which are now or may be hereafter required of -him - by law.
