LAST WILL AND TESTAMENT


Emil M. Weber of Bloomfield, Missouri

I, Emil M. Weber of the City of Bloomfield, County of Stoddard, State of Missouri, do make and publish this my Last Will and testament.

1. I give and bequeath to my son Fronz Weber, the sum of Five Dollars.

2. I give and bequeath to my son Carl Weber, the sum of Five dollars.

3. I give and bequeath to my daughter Emma Weber the sum of Five Dollars.

4. I give and bequeath to my daughter Tony Weber the sum of Five Dollars.

I further give and devise to my beloved wife, Elisabeth A. Weber, all my personal estate whatsoever; also all and every my messuage, lands, tenements and hereditaments, with the appurtenances, to her the said Elisabeth A. Weber, her heirs and assigns forever. And I hereby appoint the said Elisabeth A. Weber my sole Administratrix of this my Last Will and testament, hereby revoking all other Wills by me made.

In Witness whereof I have hereunto set my hand and seal this 28" day April 1900.

Signed and sealed and declared by the testator to be his Last Will and testament in the presence of us, the undersigned, who at his request and in his presence and in the presence of each other have hereunto set our names as attesting witnesses to the execution of the above and foregoing Will. This 28" day of April 1900.

County of- Stoddard In the- Probate -Court In Vacation Jan. 30, 1908

BE IT REMEMBERED, That on this - 30th -day of- January -, in the year of our Lord One Thousand Nine Hundred and- eight , before me-H.S. Green, Judge -of the-Probate -Court, held in and for- -and State of Missouri, personally appeared -W.G. Kitchen - who being duly sworn upon - -oath, depose- -and say- s -that - he -w - as - present and saw -Emil M. Weber - sign the foregoing instrument, of date -April 28th - 19 -00 - purporting to be - - the Last Will and Testament of h -im - the said -Emil M. Weber - and heard -him -publish and declare the same to be h -is - Last Will and Testament, and that at the time of signing the same, the said -Emil M. Weber -was of sound and disposing mind, and that th -e - deponent - - and Max Bion the other attesting witness - - subscribed their names thereto as witnesses to the same in the presence of the testat - or - and of each other, and at the request of the said testat -or - who was more than 21 years of age at the date of so declaring and signing said instrument.

Carl Weber, W.G. Kitchens, Lucas Ashley, and R.S. Houck of lawful age; first having been duly sworn state upon their oaths that they are personally acquainted with one Max Bion, who signed as witness to Last Will and Testament of Emil M. Weber, dated the 28th day of April 1900, and filed for Probate the 30th day of January 1908; That the said Max Bion is no longer a resident of the state of Missouri, and that his present where abouts is unknown to them, nor do they know of anyone from whom this information could be obtained. Said affiants further depose and say that they are, and long have been, acquainted With the signature of Emil M. Weber deceased, and that the signature to said will signed as witness by said Bion, is to the best of their knowledge and belief, that of Emil M. Weber, now deceased.

I, -H.S. Green, Judge -of the-Probate-Court-in and for Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of -Emil M. Weber - deceased, and signed by said -Emil M. Weber - deceased, late of-Stoddard -County,- Missouri -and having heard the testimony of -W.G. Kitchen - and -The place or residence of the other attesting witness is unknown - subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said -Emil M. Weber - deceased, and the same is therefore - admitted to probate

LETTERS TESTAMENTARY
STATE OF MISSOURI

To all to Whom these Presents shall come--GREETING:
Know Ye, That the last will and testament of - Emil M. Weber - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the - Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that - Elisabeth A. Weber - ha -s - been appointed execut -rix - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize - her - the said -Elisabeth A. Weber - as such Execut-rix -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said -Emil M. Weber - at the time of h -is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon -her - by said Last Will and Testament, so far as there shall be property and the law charge - her - ; and in general to do and perform all other acts which are now or may be hereafter required of -her - by law.

IN TESTIMONY WHEREOF, I - H.S. Green, Judge - of the Probate Court in and for said County, have hereunto signed my name and affixed the seal of the said Court at office in-Bloomfield-this - 30th - day of -January -, A.D. 19-08

EXECUTOR'S BOND, or Bond of Administrator with Will Annexed.

We, - Elizabeth A. Weber - as Principal and - Carl Weber, A.D. Wilcox, and George Houck - as Securities, are held and firmly bound unto the State of Missouri in the sum of -Ten Thousand - DOLLARS, for the payment of which we do hereby bind ourselves, our heirs, executors and administrators, firmly by these presents.

Sealed with our seals and dated at-Bloomfield -in the State aforesaid, this - 30th -day of - January -A.D. 19-08

The Condition of the Above Bond is, That if the said -Elizabeth A. Weber, Executrix -of the Last Will and Testament of -Emil M. Weber - deceased, late of-Stoddard -County, Missouri shall well and faithfully execute the said Last Will and Testament, and shall make true and faithful inventories, returns, and settlements of accounts of the Estate of the said Testator, according to law, and shall, moreover, do and perform all other matters and things touching the execution of the said Last Will and testament, as are or shall be prescribed by law, or enjoined on -her - by the order, judgment or decree of any Court having competent jurisdiction, then this obligation to be void and of no effect; otherwise to remain in full force.
