LAST WILL AND TESTAMENT


St. Louis, Missouri
I, Charles T. Brace, being of sound mind and desiring to make disposition of all my property of which I may possessed, do hereby make and declare this to be my last Will and Testament, hereby revoking any and all prior Wills.

1. I hereby order and direct that the executor of my estate shall pay all just debts which may be found to exist against me.

2. I give and bequeath my personal wardrobe to my brother Walter C. Brace, excepting such articles as may be reserved therefrom by my wife Mary R. Brace.

I give and bequeath the remainder of my personal effects, in equal parts, one-half to my brother, Walter C. Brace and one-half to my nephew Phillip B. Kimball, excepting such articles as may be reserved therefrom by my wife Mary R. Brace.

It is my intention that the bequests mentioned in this cause be carried out at all events irrespective of the value of my estate as mentioned in subsequent clauses of this Will.

3. In the event that my estate is inventoried should be found to possess an actual value of Ten Thousand Dollars or more, I hereby order and direct that the following sums be paid out of said estate:

(a) Bequests to relations:

To my brother, Walter C. Brace, now a resident of Denver, Colorado, the sum of One hundred Dollars; To my sister, Maria B. Kimball, now a resident of Ontiora, New York, the sum of One Hundred Dollars;

To my sister, Kate B. Gillpatrick, now a resident of New York City, the sum of One Hundred Dollars;

To my nephew, Porter H. Brace, son of my brother Walter C. Brace, and now a resident of Denver Colorado, the sum of One Hundred Dollars.

To my niece, Letitia Brace, daughter of my brother Walter C. Brace, and now a resident of Denver Colorado, the sum of One Hundred Dollars;

To my niece, Harriet T. Brace, daughter of my brother Walter C. Brace, and now a resident of Denver Colorado, the sum of One Hundred Dollars.

(b) Bequests to friends:

To Fred S. Bulline, resident of Kansas City, Missouri the sum of Fifty Dollars;

To Wm. A. Gardner, resident of St. Louis, Missouri the sum of fifty Dollars;

To Cecil D. Gregg, resident of St. Louis, Missouri the sum of Fifty Dollars;

It is my desire and expectation that each of the last named those parties should use the Fifty Dollars bequeathed to him for the purchase of some suitable memorial of our natural friendship.

4. All the residue and remainder of my property both real and personal, which I may own at the time of my death, I give, devise and bequeath to my wife, Mary R. Brace absolutely and in fee.

5. In the event that my estate as inventoried should not possess the value specified in clause Three of this Will, I give and bequeath all and every part of my estate to my wife Mary R. Brace, absolutely and in fee.

6. In the event that any of my beloved relations, hereinbefore mentioned should in the judgement of my wife need financial assistance, it is my desire that she use for their relief such portions of the fund which she desires from my estate as she may consider just and wise.

This expression of my desire and request as to what my wife shall do for my relatives is not to be construed as a limitation upon the absolute estate given to her by the fourth or fifth clause in my Will. It is for her alone to determine to what extent, if at all, she is carry out my wishes in this regard.

7. I hereby name and appoint Cecil D. Gregg, of St. Louis, Missouri, to serve as executor of my estate without bond.

In Witness whereof I have hereunto set my name this 14th day of August, 1907.

The foregoing instrument was by the said Charles T. Brace, declared to us to be his last will and Testament, and we attest the same by subscribing our names hereto at the request and in the presence of the said Charles T. Brace, this 14 day of August 1907.

Be it remembered, That in presence of authority to me given by the annexed commissioned by the Judge of the Probate Court within and for the county of Stoddard in the State of Missouri, I , the undersigned Charles J. Anderson a Notary public within and for the City of St. Louis in the State of Missouri, did on this 19th and 23rd day of October A.D. 1911, respectively cause to come before me Henry T. Farris and S.G. Ray the persons therein named, who being by me duly sworn on oath did depose and say: We saw Charles T. Brace the testator subscribe his name to the annexed instrument in writing, bearing date {words covered} /pg.3/ day of August 1907 and heard him declare the same to be his last will and testament. We subscribed our name thereto as witnesses in the presence at the request of the said testator and at the time of the execution of said instrument in aforesaid and of our subscribing the same as such witnesses he, the said testator was of sound and disposing mind, to the best of our knowledge and belief.

I, - Wm. L. Tucker, Judge - of the-Probate-Court-Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of -Charles T. Brace - deceased, and signed by said -Charles T. Brace - deceased, late of-Stoddard -County,- Missouri -and having seen the testimony of -Henry T. Ferris - and -S.G. Ray - subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said -Charles T. Brace - deceased, and the same is therefore -is hereby admitted to Probate.

To all to Whom these Presents shall come--GREETING:
Know Ye, That the last will and testament of -Charles T. Brace - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the - - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that -Cecil D. Griggss - ha -s - been appointed execut -or - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize -him - the said -Cecil D. Greggs - as such Execut-or -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said -Charles T. Brace - at the time of h -is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon - him - by said Last Will and Testament, so far as there shall be property and the law charge - him - ; and in general to do and perform all other acts which are now or may be hereafter required of -him - by law.
