LAST WILL AND TESTAMENT


Will of James R. Graham

In the name of God, Amen. I, James R. Graham of the county of St. Francois in the State of Missouri, aged Sixty nine years, being of sound mind and disposing memory, do, make and publish this my last will and testament, as follows:

1. I direct that my funeral charges, and all my just debts be paid by my executor out of my estate.

2. I direct that my wife Mary Graham shall have that interest in my estate that is by law allowed her as my widow.

3. I will and bequeath to my adopted son Roy Henley the sum of two hundred dollars in cash.

4. I will, devise and bequeath all the rest, residue and remainder of my estate, real personal of every description, to Roy Henley above mentioned, Ernestt Welch, Henry Welch, Allie Welch, Marvin Welch, Emma Elba Welch and Mattie P.E. Welch, share and share alike. If any of these devisees shall have died at the time of my death his or her share shall be taken equally be the remaining devisees. The Welch children herein named are the children of Verna Augusta Welch of the County of St. Francois State of Missouri.

5. I hereby appoint R.M. Talbort, Executor of this my last will and testament.

In witness whereof I have hereunto subscribed my name, this 9th day of November 1910.

The foregoing instrument was at the date thereof signed and declared by the said James R. Graham to be his last will and testament, in the presence of us, who, at his request and in his presence, and the presence of each other, have subscribed our names as witnesses thereto.

Commission to Prove Will

The State of Missouri, To any Judge or Justice of the Peace or any Mayor or Chief Magistrate of any City in the County of St. Francois, Greeting:

Know Ye, That, reposing confidence in your ability, we do hereby empower you to cause to come before you at a time and place to be by you appointed Emil M. Hering M.D. & Bessie Brady, attesting witnesses to the annexed instrument of writing, purporting to be the last Will and testament of James R. Graham deceased, and the said officer to examine on oath touching their knowledge of the execution of said instrument of writing and of the condition of mind said James R. Graham at the time of the publication of said instrument of writing. The examination of said Emil M. Hering and Bessie Brady, thus taken, you will reduce to writing and cause them to subscribe the same and the examination thus taken and subscribed, you will certify to the Clerk of our Probate Court within and for the County of Stoddard, State of Missouri, under your hand.

Before Kossuth C. Weber Judge of Probate Court St. Francois County, Mo.
In pursuance of the authority to me given by the annexed commission issued by the clerk of the Probate Court within and for County of Stoddard and State of Missouri, I Kossuth C. Weber, Judge of Probate Court, did on the 13th day of August A.D. 1912, cause to come before me at the courthouse in the City of Farmington and State of Missouri Emil Hering & Bessie Brady, who being by me duly sworn deposeth and say, That the said James R. Graham, the testator subscribed the same in their presence, and published and declared said will or instrument of writing to be his last will and testament, and that at the time of said signing the same he the said testator was of sound and disposing mind and more than twenty one years of age and that said deponents attested said will as witnesses thereto by subscribing their names to the same in the presence of the testator and of each other and at the request of said testator, and further deponents saith not.

I, -Wm. L. Tucker, Judge- of the-Probate-Court-of Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of -James R. Graham- deceased, and signed by said -James R. Graham - deceased, late of-Stoddard -County,--and having heard the testimony of -Emil M. Hering M.D. - and - Bessie Brady, under commission to prove will - subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument - - the Last Will and Testament of said -James R. Graham - deceased, and the same is therefore - admitted to probate.

LETTERS TESTAMENTARY

To all to Whom these Presents shall come--GREETING:
Know Ye, That the last will and testament of - Jas R. Graham - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the -Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that -R. M. Talbert, - ha -s - been appointed execut -or - in and by said Last Will and Testament, to execute the same, has refused to except said trust and execute said Will and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby appoint Joseph W. Farris administrator with the will of said Jas R. Graham, dec'd hereto annexed and do authorize the said Joseph W. Farris - as such Adm. -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said - Jas R. Graham- at the time of h - is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon - him - by said Last Will and Testament, so far as there shall be property and the law charge - him - ; and in general to do and perform all other acts which are now or may be hereafter required of - him - by law.

IN TESTIMONY WHEREOF, I -Wm. L. Tucker, Judge - of the Probate Court in and for said County, have hereunto signed my name and affixed the seal of the said Court at office in-Bloomfield-this - 15th - day of -August -, A.D. 19- 12

EXECUTOR'S BOND, or Bond of Administrator with Will Annexed.

We, -Joseph W. Farris - as Principal and -A.D. Wilcox and George Houck - as Securities, are held and firmly bound unto the State of Missouri in the sum of -Fifteen hundred - DOLLARS, for the payment of which we do hereby bind ourselves, our heirs, executors and administrators, firmly by these presents.

Sealed with our seals and dated at-Bloomfield, Mo. -in the State aforesaid, this - 15th -day of -August -A.D. 19-12

The Condition of the Above Bond is, That if the said -Joseph W. Farris, administrator with will annexed -of the Last Will and Testament of -Jas. R. Graham - deceased, late of-Stoddard -County, Missouri shall well and faithfully execute the said Last Will and Testament, and shall make true and faithful inventories, returns, and settlements of accounts of the Estate of the said Testator, according to law, and shall, moreover, do and perform all other matters and things touching the execution of the said Last Will and testament, as are or shall be prescribed by law, or enjoined on - him - by the order, judgment or decree of any Court having competent jurisdiction, then this obligation to be void and of no effect; otherwise to remain in full force.
