LAST WILL AND TESTAMENT


In The Name of God Amen
I, Smith Sampson, of the City of Murphysboro, in the County of Jackson and State of Illinois, being of sound mind and memory, and considering the uncertainty of this frail and transitory life do therefore make, ordain, publish and declare this to be my Last Will and Testament.

First. I order and direct that my Executrix hereinafter named pay all my Just debts and funeral expenses, out of my estate as soon after my death as conveniently may be.

Second. After the payment of such funeral expenses and debts, I give devise and bequeath all of my estate and property of whatsoever kind and nature of which I may died seized to my beloved wife, Lutisha Sampson save and excepting the sum of two hundred dollars, if so much thereof shall remain and to be paid at the death of my said wife, which said sum, I give, devise and bequeath to the trustees of Murphysboro Lodge #498 A.F. and A.M. of the City of Murphysboro, Illinois, the interest only thereof annually to be used in taking care of my grave and the grave of my said wife.

Lastly, I make constitute and appoint my said wife Lutisha Sampson to be executrix of this my last Will and Testament and I request that she be allowed to act without bond, hereby revoking all former wills by me made. In witness whereof I the said testator hereto subscribe my name and affix my seal the 16th day of April in the year of our Lord One Thousand Nine Hundred and Thirteen (1913)

BE IT REMEMBERED, That on this - -day of- -, in the year of our Lord One Thousand Nine Hundred and- Fourteen , before me -Wm. L. Tucker, Judge - of the-Probate -Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared - - who being duly sworn upon - -oath, depose- - and say- -that - they -w - ere - present and saw -Smith Sampson - sign the foregoing instrument, of date - April 16th - 19 -13 - purporting to be - - the Last Will and Testament of h - im - the said -Smith Sampson - and heard - him -publish and declare the same to be h - is - Last Will and Testament, and that at the time of signing the same, the said -Smith Sampson -was of sound and disposing mind, and that th - e - deponent - s - and -John R. Thorp, C.G. Grizzell, W.H. Massey - other attesting witness - - subscribed their names thereto as witnesses to the same in the presence of the testat - or - and of each other, and at the request of the said testat -or - who was more than 21 years of age at the date of so declaring and signing said instrument.

Tucker, Judge - of the-Probate-Court-Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of -Smith Sampson - deceased, and signed by said -Smith Sampson - deceased, late of-Stoddard -County,- -and having heard the testimony of -John Thorp - and -C.C. Grizzell and W.H. Massey as shown by return of commission to take proof - subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument - - the Last Will and Testament of said - Smith Sampson - deceased, and the same is therefore -admitted to Probate

LETTERS TESTAMENTARY

To all to Whom these Presents shall come--GREETING:
Know Ye, That the last will and testament of - Smith Sampson - deceased, late of-Jackson -County, Ill., hath, in due form of law been exhibited, proved and recorded, in the office of the - - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that - Lutisha Sampson - ha -s - been appointed execut -rix - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize -her - the said - Lutisha Sampson - as such Execut-rix -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said - Smith Sampson - at the time of h - is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon -her - by said Last Will and Testament, so far as there shall be property and the law charge -her - ; and in general to do and perform all other acts which are now or may be hereafter required of -her - by law.
