LAST WILL AND TESTAMENT


In the Name of God, Amen:
I, Stephen H. Gibson, of Stoddard County, Missouri, aged 33 years, being of sound and disposing mind and memory and realizing the certainty of death, do make and publish this my last will and testament:

1st - I will that all my just debts including my funeral expenses shall be paid out of my personal estate.

2nd - I will and bequeath to my beloved wife, Dixie Jane Gibson, all my personal estate, to her own absolute use and benefit.

3rd - I will and bequeath, subject to the life dower of my beloved wife Dixie Jane Gibson, the following described real estate, to wit: The North East quarter of the South East quarter of Section 36 Township 26 Range 10 East 40 acres, equally and jointly, to Francis Ader Gibson, Eley Jane Gibson, and Stephen Richman Gibson, Annie Alice Barker, Elizabeth Barker and James A. Barker the above named being my beloved children and Step-children.

And I further will that should there be born to myself and wife any other child or children, that such issue shall share equally with the children above named in the land above described.

4th - I constitute and appoint my beloved wife Dixie Jane Gibson my executrix of this my last will and testament, and request that she execute the duties of said will without bond.

We the undersigned at the request of the testator in his presence and in the presence of each other saw said testator Stephen H. Gibson sign his name to the foregoing instrument and heard him declare said indenture to be his last will and testament, and at his request and in his presence and in the presence of each other we have signed the same as witnesses thereto.

On this 22nd day of March, 1917, before the undersigned M. Walker Cooper, Judge of Probate, personally appeared Dixie Jane Gibson who being duly sworn, says that to the best information and belief of affiant Stephen H. Gibson died testate at Bloomfield, Missouri on the 21st day of March, 1916, leaving as his heirs at law Dixie Jane Gibson, widow, Francis A. Hankins, daughter, Eley J. Cox, daughter, Stephen R. Gibson, son, Phonie F. Gibson, son, and Bertie P. Gibson, son, all of Stoddard County Missouri.

BE IT REMEMBERED, That on this -22nd -day of-March -, in the year of our Lord One Thousand Nine Hundred and- Seventeen, before me -M. Walker Cooper, Judge- of the-Probate -Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared -J.M. Triplett and M.S. Phelan - who being duly sworn upon -their -oath, depose- - and say- -that -they -w -ere - present and saw - Stephen H. Gibson - sign the foregoing instrument, of date -April 1897 purporting to be - - the Last Will and Testament of h - im - the said - Stephen H. Gibson - and heard -him -publish and declare the same to be h - is - Last Will and Testament, and that at the time of signing the same, the said - Stephen H. Gibson -was of sound and disposing mind, and that th -ese - deponent - attesting witness - - subscribed their names thereto as witnesses to the same in the presence of the testat -or - and of each other, and at the request of the said testat -or - who was more than 21 years of age at the date of so declaring and signing said instrument.

LETTERS TESTAMENTARY

To all to Whom these Presents shall come--GREETING:

Know Ye, That the last will and testament of -Stephen H. Gibson- deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the - Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that -Dixie Jane Gibson - ha -s - been appointed execut -rix - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize -her - the said -Dixie Jane Gibson - as such Execut- rix -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said - Stephen H. Gibson - at the time of h -his - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon - her - by said Last Will and Testament, so far as there shall be property and the law charge - her - ; and in general to do and perform all other acts which are now or may be hereafter required of -her - by law.
